Terms and conditions
The NK Maribor application is an information system designed to present and sell products, tickets, drinks and food to users. The general terms and conditions for the application of Nogometni klub Maribor Branik are drawn up in accordance with the Consumer Protection Act. It is advised that you read the terms and conditions below carefully before using the application, as you express your agreement to the terms of use of the application.

App users
The user is a natural or legal person who uses the application system. In order to do business with legal entities, you need to contact our commercial department. A natural person is exclusively a registered user who obtains or uses the products for purposes outside the users professional or gainful activity. Customers who are natural persons under this paragraph are subject to the provisions of the Consumer Protection Act. The club Nogometni klub Maribor Branik and users of the online shopping govern their mutual obligations with these General Terms and Conditions.
Login
When registering in the application, personal information is collected (including first and last name, shipping address, contact information, date of birth). The user obtains a username that is the same as the user’s email address and a password the user selects. The username and password unambiguously determine the user and link the user to the completed information. Prior to use, the user must confirm the identity of the information entered by selecting the link in the email the user received automatically upon registration. Upon confirmation, the user becomes a registered user with a username and password, with which the user can access the account or acquire the right to purchase products. The Terms and conditions address the application's operation, user rights, and the business relationship between the administrator and the user. Alternatively, the user can log in with a Google or Facebook account.
Prices and validity of the offer
All prices are in EUR and include value added tax (VAT), unless otherwise stated. Prices are subject to change without notice. Errors are possible and no liability is assumed except for defects in the product. If the price of the product you have ordered is incorrect, we will inform you and offer you the opportunity to buy the product at the correct price, which we will also provide. We reserve the right to correct the error within eight working days of the day the order was placed. We reserve the right to change product descriptions and configurations without notice.
Data up-to-date
The administrator does his best to ensure that the site includes accurate and up-to-date information on services (tickets), products, prices and stock. However, it assumes no liability for damages or other liability for errors in the contents of the website. In the event that an online store user estimates that this information is incorrectly displayed, he or she may report the error via contact information. The administrator is also not responsible for the occasional failure of the online store and the inability to access
Ordering products and tickets
Ordering through the application is enabled 24 hours a day, all days of the year. The user selects and orders the products and tickets available in the app, sorted in categories.
Ordering food and beverages
Ordering is available through the app only on the day of the match and the exact hours are announced by the administrator. The user selects and orders the food and beverages available in the app, sorted in categories.
Method of payment
There are several payment methods available in the application: payment with a club prepaid card (a season ticket is also valid) or using a payment or credit card (Activa, MasterCard®, Visa, Visa Electron, Maestro and others). The purchase contract or order is stored electronically on the server of the application’s administrator and is accessible to the customer 24 hours a day in the section My Maribor.
Invoicing
The invoice for purchased products can be found in users account under the My Maribor tab.
The customer is obliged to check the correctness of the data before placing the order. Later objections to the invoices issued are not taken into account.
Delivery time of products
Delivery takes 2 to 4 working days for stock items. Out of stock items cannot be ordered.
Product delivery
The products ordered in the application are delivered by our contractual partner: Pošta Slovenije. Delivery is made to the address you provided when ordering. Delivery is mainly done in the morning, so it is recommended that you specify a delivery address where you will be available in the morning. If the delivery was unsuccessful or you were absent at the time of delivery, the delivery service will leave a notification and you can call them later and arrange the delivery yourself. It is also advisable to include a telephone number at which you can always be reached when ordering, since in the case of a larger package they will call you beforehand.
Ticket delivery
Tickets purchased on the application will be sent to your email account which you used to register for the application.
Delivery costs
Delivery costs are calculated before the order is completed. The cost of shipping within Slovenia is 4,00 € and for the rest of the world it is automatically calculated when you enter the data.
Cancellation of purchase and return of products
The user has the right to return the purchased products without stating the reason for the return. The buyer must notify the seller in writing with the form and a copy of the invoice, not later than 14 days after receiving the products, by e-mail to info@nkmaribor.com or in writing at the club headquarters. This message is considered to be a notice of withdrawal. The buyer must then return the products within 14 days of the written notice. The buyer is liable for a value reduction of the products if the decrease is the result of conduct which is not strictly necessary to establish the nature, propriety and functioning of the products. A copy of the original invoice received upon receipt of the goods must be enclosed with the return. Payments received for returned products will be credited to your transaction account or PayPal account. In the event of termination of the contract, the club shall immediately, or no later than 14 days after receiving the notice of withdrawal, return all payments received. The company shall return the payments to the consumer by the same payment method as the consumer used, unless the consumer explicitly requested the use of another payment method and the consumer does not bear any costs as a result. The club may withhold the refund of the payments received until the products have been returned.
Nogometni Maribor Branik does not recognize any ACDR contractor as competent to resolve a consumer dispute that a consumer may initiate in accordance with the law.
Nogometni klub Maribor Branik, as a provider of online sales, publishes an electronic link to the Online Consumer Dispute Resolution (OCDR) platform on its website. The platform is available online at http://ec.europa.eu/odr

Real defects
The consumer may exercise rights as a result of a material defect if the consumer informs the seller about the defect within two months from the day when the defect was discovered. The consumer must accurately describe the defect in the error message and allow the seller to inspect the matter.
The seller is not responsible for any material defects in the products which appear after two years have elapsed since the item was delivered. A defect on products is considered to have existed at the time of delivery if it occurs within six months of delivery.
The consumer who has duly informed the seller of the defect has the right to require the seller to:
• rectify the defect in the products or return part of the amount paid in proportion to the defect or
• replace the defective products with a new flawless item or
• return the amount paid.

Warranty
If the products for which a guarantee is required does not function properly or does not have the features listed in the warranty card or advertising message, the consumer may request that the defects be rectified. If the defects are not remedied within a total of 45 days from the date on which the manufacturer, seller or authorized service provider receives a request for rectification from the consumer, the manufacturer shall replace the products with identical, new and faultless products free of charge to the consumer.
If the manufacturer does not repair or replace the products with a new one within the period referred to in the previous paragraph, the consumer may terminate the contract or request a reduction of the purchase price.
The manufacturer must issue a new warranty certificate for the products replaced or the essential part replaced.
The consumer's rights referred to in this Article shall expire after two years from the date on which the consumer requested the rectification of the defects free of charge or the replacement of the new products.

Product complaints
The buyer may complain if the products do not have the properties explicitly promised by the seller, if the seller has sent the wrong products, in the wrong quantity or in the wrong color. The buyer can send a complaint within 8 days of receiving the shipment and request immediate replacement for the same, faultless product. In the event of a complaint, the buyer may, in accordance with legal restrictions, request the replacement of the product, its repair or a refund. The buyer may return the faulty products by bringing them in person or send them at our expense and by prior arrangement with us by mail. Shipment by cash on delivery is not accepted.
Ticket complaints
Pursuant to point 12 (43.č) of the Consumer Protection Act, the consumer does not have the right to withdraw from the contract for leisure services in which the company commits to fulfill its obligation at a specific date or within a specified time. In view of the aforementioned statutory exception, under which the consumer has no right to withdraw from the purchase of tickets, all ticket orders are binding, regardless of the ordering method. Tickets for all Nogometni klub Maribor Branik events that have been purchased through the app cannot be returned, exchanged or refunded. In the event of cancellation of the event, change of the date or time of the event, the event organizer is in all cases responsible for managing the situation and returning the money. Upon the occurrence of these circumstances, Nogometni klub Maribor Branik will inform ticket buyers as soon as possible of the validity of the tickets and the possibilities of refund. Refunds are payable only if the event is canceled, otherwise tickets are valid for the rescheduled event date or time.
In case of lost or stolen tickets, the buyer is not entitled to reimbursement of costs, replacements or replacement tickets.
It is the responsibility of the buyer to check the validity of the date, time and location of the event for which the ticket has been purchased. Upon receipt of the ticket, the buyer is obliged to immediately check the ticket and in case of any errors in the printout of the ticket (such as incorrect event, date, time and location of the event and incorrect indication of the chosen seat) immediately alert the seller. Subsequent complaints are not considered.
Protection of personal data
The application administrator is committed to the correct use of personal data. Pursuant to the Personal Data Protection Act, a company is required to protect the personal data of users of the application. The administrator is committed to permanently protect all personal information of the user. The administrator will use personal information solely for the purpose of fulfilling the order (sending order notices, sending offers and invoices) and other necessary communication. In no case will the user's data be handed over to unauthorized persons. By registering, the user allows the administrator to collect and use the personal information the user provided upon registration and eventual confirmation of the purchase. All information provided by the user is intended only for the operations of the administrator, who does not provide it for other purposes or to a third party. The user is also responsible for the protection of personal data by ensuring the security of his user name and password. We are not responsible for the accuracy of the information provided by the user when registering in the online store.
Use of personal information
Personal information collected through the seller's application is used for the operation of the application and for the performance of the services or transactions the user has requested or agreed to. Seller uses the user’s personal information to:
• provide better and more efficient customer service,
• improve application performance, service and follow information technology development trends,
• makes the application more user-friendly by implementing the latest application usage tools,
• keeps the user informed of important updates on sales and notifications from organizers,
• for research purposes, we will use the data about the app visits to calculate statistics.
If you subscribe to the newsletter, when you register with the seller's application, the seller uses technology that reports that you have clicked on the link provided in the email. We may combine this information with your personal information in order to provide you with more specialized email or information. Each email contains a link that allows you to stop receiving such email.
Exceptional disclosure of personal information
Data collected and processed by the administrator will only be disclosed if required by the Personal Data Protection Act or in good faith that such action is necessary for proceedings before the courts or other public authorities.
Communication
The administrator will only contact the user through the means of distance communication if the user subscribes to news and notifications. In case of problems or ambiguity in the use of the application and the possible purchase of products, the administrator reserves the right to contact the user through the means of distance communication. Advertising emails will be clearly and unambiguously marked. The sender will be clearly visible, and various campaigns, promotions and other marketing techniques will be marked as such. The conditions of participation will also be clearly defined. The method of unsubscribing from receiving advertisement messages will be clearly presented, and we will explicitly consider the desire of the user not to receive advertisement messages.
Complaints
Because we comply with applicable consumer protection laws, we have an effective complaint handling system. In case of problems, you can contact us by phone +386 2 228 47 04 or via email info@nkmaribor.com. Upon receipt of the complaint, we will notify you within 5 business days of how long it will take and will keep you informed of the progress of the process. We also commit ourselves to do our best to resolve any disputes by mutual agreement.
Copyright
The application and all data, product descriptions, code, technologies, product images and graphics and other non-listed elements displayed in the application are protected and may not be reproduced or used without our prior written permission.
Tickets
It is not possible to enter the match at the Ljudski vrt stadium without presenting a ticket or season ticket. A day ticket can be purchased on match day at the Ljudski vrt stadium, at both the Vijol’čna Bajta fan shop and at the club's online store or app.
Season tickets
Season tickets can be purchased at both Vijol’čna Bajta fan shops and the club's online store or app. Season ticket is personalized, non-transferable and non-transferable. It can only be used by the person listed on the season ticket. Lending a season ticket or other misuse of a season ticket is considered a criminal offense and is punishable by withdrawing an annual ticket and reporting it to the police.
All information provided by the buyer of the season ticket to the match organizer shall be collected, stored and used explicitly for the purpose of fulfilling the contract, unless explicit consent of the user to the widespread use of the data is provided.
A season ticket is a permanent ticket that can be renewed for the next season before the end of the current season.
The season ticket can also be used as a prepaid card.
Making a duplicate season ticket is payable.
Season ticket buyers have the opportunity to take advantage of additional benefits: discounts on the purchase of club items, pre-purchase rights to buy a season ticket for the next season, pre-purchase rights to buy tickets for European matches, casual campaigns throughout the season. Season ticket holders are kept up to date with club activities.
Miscellaneous
Any dispute between the parties will be settled primarily by mutual agreement, but if this would not be possible, the competent court of Maribor has jurisdiction.
Nogometni klub Maribor Branik may change the General Terms and Conditions at any time, and any changes will be published on a publicly accessible media beforehand.
